Public and private swimming pools are accident scenes. There are several causes of these particular kinds of accidents, but more common causes involve no fencing around the swimming pool, improper fencing, negligence of the property owner, negligence on the behalf of babysitters or caregivers for the victims. Poorly designed swimming pools or defective designs, pool pump malfunctions, or swimmers attempting to dive when the water is too shallow can lead to swimming related accidents. If you or your loved one suffered injuries in a swimming pool-related accident caused by the negligence of someone else, you could be eligible to recover damages.

Swimming Pool Safety Tips to Prevent Accidents

Just like other states, Arizona has specific swimming pool safety regulations in place. In Arizona, owners of swimming pools can be held liable if they fail to maintain their pool and ensure its safety:

  • Fencing at least five feet tall must enclose the pool area;
  • There shouldn’t be any openings to allow in things larger than four inches in diameter unless it is a gate or a door;
  • There should not be anything that enables someone outside the pool area to climb the fence. This could include openings, footholds, or handholds; and
  • The barrier should be a minimum of 20 inches from the water’s edge.

The Arizona Department of Health Services website offers additional information about swimming pool safety.

For additional safety, adhere to these pool safety tips to further decrease the risks of swimming pool accidents and the liability you would encounter from such accidents.

  • Children shouldn’t be left unattended. Always supervise children when they are near a pool or in a swimming pool.
  • Don’t substitute supervision even if there have been extensive swim lessons or if floatation devices are in use.
  • Make sure those supervising swimming areas know CPR.
  • Never leave pool doors or gates propped open.
  • Remove objects that might be used by someone to climb over a gate.
  • Only dive in deep water.
  • Don’t drink and swim.
